On November 15, 2020, Fox News aired a Sunday Morning Futures episode whose rush transcript is still posted. Maria Bartiromo asked Sidney Powell how “a gentleman named Peter Neffenger” “fits into all of this.” Powell answered, on the transcript:

“He is president and on the board of directors of Smartmatic. And it just so happens he’s on Mr. Biden’s presidential transition team that’s going to be nonexistent, because we’re fixing to overturn the results of the election in multiple states.” Sidney Powell, Fox News rush transcript, Nov. 15, 2020

Powell then alleged that President Trump “won by not just hundreds of thousands of votes, but by millions of votes, that were shifted by this software that was designed expressly for that purpose,” and that “He was fully briefed on it.” In context she was describing the software and the people she said were behind Smartmatic and Dominion. Those sentences are allegations. They were later the subject of defamation litigation. They are not a court finding that Neffenger shifted votes, designed vote-shifting software, or was briefed on a rigged system.

Powell’s title for him (“president and on the board”) does not match the October 2018 Smartmatic release, which named him chair of a newly formed U.S. board. Smartmatic is not established in the records cited here as a Dominion subsidiary. Snopes and Smartmatic’s own statements treated the companies as competitors. This post records what Powell said on a published transcript. It does not convert her claims into facts about Neffenger.
